Many employers are nervous about the effects of cold and flu on the workplace. Can you send them home due to an illness, such as the common cold?
Yes. OSHA guidelines recommend employees who are sick stay home, and the CDC advises that individuals only return to work 24 hours after a fever subsides.
A workaround? Allow employees to telecommute.
Be smart. The rule for sending employees home with the common cold doesn’t extend to sending people home who have serious illness and may be covered by the Americans with Disabilities Act or the Family Medical Leave Act.
